Unconstitutional - Let's Repeal Obamacare

OK, Obamacare is so bad it's unconstitutional. The new health care law forces everyone to buy health care insurance or pay a fine which is levied through the IRS and your tax returns. Such a burdensome mandate on all Americans has not been passed since the Income Tax law. Many experts even today argue that the Income Tax law was and is unconstitutional.

Luckily we have the courageous Attorney General of Virginia, Ken Cuccinelli II who has filed a lawsuit challenging the constitutionality of the new health care law commonly referred to as Obamacare. Cuccinelli is directly challenging the new law's mandate that forces all Americans to purchase health care insurance. And he has just won an early victory in the lawsuit. U.S. District Judge Henry E. Hudson ruled on Aug 3rd that the lawsuit should not be dismissed and that it can proceed to a full hearing in his court on Oct 18th. Cuccinelli is right to challenge Obamacare on these grounds. His state just passed its own law that makes it illegal to require Virginia's citizens to buy health insurance. This is clearly a state's rights versus the federal government's rights issue. We all know the US Constitution gives more rights to the States than to the Federal Government, no matter how much power the feds have usurped and the states have willingly given up since the founding of this great country.

But Cuccinelli and Virginia aren't the only ones that filed a suit challenging the constitutionality of Obamacare. Twenty states have joined Florida to challenge the new health care law because it forces all states to greatly expand their Medicaid programs. I'll have more on this lawsuit in my next post.

Till then do what you can to let your US State Representative and Senators know that you support repealing Obamacare.
